FOREIGN BUYERS AND SELLERS MUST REPORT U.S. AGRICULTURAL LAND HOLDINGS

Kahului, Hawaii, January 5, 2011- Foreign investors with an interest in agricultural lands in the United States are required to report their holdings and any transactions to the U.S. Secretary of Agriculture, through the USDA Farm Service Agency.

Any foreign person who acquires or transfers any interest, other than a security interest, in agricultural land in the United States is required by law to report the transaction no later than 90 days after the date of the transaction.

Foreign investors or entities must file Agricultural Foreign Investment Disclosure Act (AFIDA) reports with the Farm Service Agency County Office that maintains reports for the county where the land is located.

Failure to file a report, filing a late report or filing an inaccurate report can result in a penalty with fines up to 25 percent of the fair market value of the agricultural land.

For AFIDA purposes, agricultural land is defined as any land used for farming, ranching or timber production, if the land is more than 10 acres in size or if the land is 10 acres or less and in the aggregate producing gross annual receipts of more than $1,000 from the sale of farm, ranch, or timber products in total.

Disclosure reports are also required when there are changes in land use. For example, reports are required when land use changes from nonagricultural to agricultural or from agricultural to nonagricultural.

When the Agricultural Foreign Investment Disclosure Act was signed into law in 1978, the reporting requirement was adopted as part of the same legislation. Data gained from these disclosures is used in the preparation of periodic reports to the President and Congress concerning the effect of such holdings upon family farms and rural communities in the United States.

Foreign investors must also file a report when there is a change in the status of ownership such as owner changes from foreign to non-foreign, from non-foreign to foreign or from foreign to foreign.

USDA ANNOUNCES IMPLEMENTATION OF THE LIVESTOCK FORAGE DISASTER PROGRAM

Kahului, Hawaii, April 27, 2011 – The USDA Farm Service Agency announced that producers on Maui, Molokai and Lanai may now begin applying for benefits under the Livestock Forage Disaster Program (LFP) for crop year 2011.

The USDA Farm Service Agency is committed to meeting the needs of producers who have suffered devastating losses due to a natural disaster. This program ensures that producers who have suffered agriculture losses receive the critical disaster assistance needed to remain financially solvent and help them continue on in their operations.

LFP provides direct payments to eligible livestock producers that have suffered livestock grazing losses due to qualifying drought or fire. For drought, the losses must have occurred on land that is native or improved pastureland with permanent vegetative cover or a crop planted specifically for grazing. The drought losses must also have occurred during the normal grazing period for the specific type of grazing land in the county. For fire, LFP provides payments to eligible livestock producers that have suffered grazing losses on rangeland managed by a federal agency if the eligible livestock producer is prohibited by the federal agency from grazing the normal permitted livestock on the managed rangeland due to a qualifying fire.

LFP eligibility is limited to producers who have purchased Noninsured Crop Disaster Assistance Program (NAP) or crop insurance coverage for 2011. Producers who meet the requirements of socially disadvantaged, limited resource or beginning farmer or rancher do not have to meet risk management purchase requirements. An average adjusted gross nonfarm income (AGI) limitation of $500,000 applies and is determined using the three taxable years that precede the most immediately preceding complete taxable year (for 2011, the applicable years are 2007, 2008 and 2009).

Eligible livestock must be maintained for commercial agricultural use. Eligible livestock under LFP include beef and dairy cattle, alpacas, buffalo, beefalo, deer, elk, emus, equine, goats, llamas, poultry, reindeer, sheep and swine. For losses due to drought, qualifying drought ratings are determined using the U.S. Drought Monitor located at http://www.drought.unl.edu/dm/monitor.html.

Livestock maintained for other than commercial agricultural use, such as rodeo stock, trail ride horses, or livestock for personal consumption are ineligible for benefits under LFP.

Hi NBRs, 

hope you don't mind me chiming in on this.  I'm a physical therapist on your referral list and i think I can give you some good insight to your question:

Lindsay, 

referred pain down the leg (sciatic symptoms) is very common and can come from a few different things.  piriformis syndrome is one of them but it may also come from the low back.  the exercise that Owen recommended (door jam stretch) is pretty good.  in addition to stretching the hamstrings its also a great nerve gliding exercise.  

Lindsay let me ask you a few questions and maybe I can help you find the best stretch/exercise to help you with your pain. (hopefully this will help everyone with similar pains)
1. have you had this type of pain before? if so, how often?
2. does your pain increase or decrease with any position (sitting, standing, back sleeping)?
3. did this begin when running? if not, were you doing anything in particular?

i think those few facts can help to narrow down what may be going on to cause your symptoms.

As a chiropractor I have to agree with much of what has been said here. The most likely culprit is the piriformis and stretching as well as strengthening it will help. Stretching pre and post run is helpful but for better results stretching and strengthening the muscle on your days off will speed recovery. Finally most people have jobs where they sit all day long. Nothing could be worse for piriformis. Getting up every 30 minutes and walking for 60 secs is a necessity. This should be automated via your smart phone or computer as most will never remember on their own.

Piroformis syndrome that doesn't respond to these remedies needs to be treated by a professional. My experience with the problem is that it responds well to electric stimulation, trigger point therapy and pevlic balancing via spinal manipulation and blocking.

another good one for the low back is to lie on your back, bring one knee (say your right) into your chest, then cross over your body while looking in the other direction.  hold for 30 seconds.  bring same knee back into your chest, then return to the floor.  repeat with left side.

Also... try stretching your hamstrings... lie on your back and get a towel around your foot - pull the towel and your foot closer and closer to your chest... not too much that its uncomfortable - hold for 30 seconds, and then bring it in a bit more.  Switch sides.

I find these really help.  Also, take a hot shower and stretch in the shower - touching your toes, or going as far as you can - while the hot water is hitting your low back.

I’m reading every email and saving them for my next go-around with the cleanse.  But I haven’t been responding.  I’m there with all of you in spirit!  Regarding three days with no weight loss, I wouldn’t worry.  That has happened to me.  I have lost additional pounds after I start eating again just because ingesting food jump-started my metabolism.  But I also have an exceptionally fast metabolism and that just might be me.

 

Don’t worry about not losing weight.  Your body is cleansing, you are getting healthy, you are taking care of your body, mind, and soul.  Losing weight is a side benefit, not the goal. Besides, when you are done, your skin will be so radiant that no one but you is going to know that you didn’t lost those two extra pounds.  J

I started last week too.  I'm on Day 7 and I've lost 10 pounds.  Yahh!
From 178 down to 167 and going strong.
 
This is my 4th cleanse and the EASIEST of all of them so far.  The first 2 times were very difficult.  The last one was somewhat uneasy and unfortunately, due to personal life meeting major changes, I gained 25 pounds to my highest weight.  It all felt toxic, inflammation, joints hurting, felt fat and heavy and tired and lazy.
 
But this time starting the diet has been a cinch. Never hungry and don't need to load up on the juices or drinks or soups as often.  I can't get over it.  I really do think time of year has a LOT to do with it. Spring is definitely the best time.  So for any of you just sitting on the fence as to whether to do it, NOW would be a good time!

FSA COUNTY COMMITTEE NOMINATIONS START JUNE 15

(COLLEGE STATION, TX), May 16, 2011 -USDA Texas Farm Service Agency (FSA) Executive Director Juan M. Garcia, announced that county committee election nominations begin June 15, 2011. Farmers, ranchers and landowners are encouraged to nominate farmer and rancher candidates to serve on their local FSA county committee by the August 1, 2011 deadline.

Elected county committee members serve a three-year term and are responsible for making decisions on FSA disaster, conservation, commodity, and price support programs, as well as other important federal farm program issues.

"County committee members are a valuable asset because they are local producers who participate in FSA programs themselves and have a direct connection to farmers and ranchers in the community," said Garcia. "I would like to see a high level of participation in this year’s nomination and election process," he said.

Producers may nominate themselves or others as candidates. Organizations that represent minority and women farmers and ranchers may also nominate candidates. Nominees must participate in a program administered by FSA, be eligible to vote in a county committee election and reside in the local administrative area (LAA) in which the person is a candidate. To become a nominee, eligible individuals must sign form FSA-669A. The form and more information about county committee elections are available online at: www.fsa.usda.gov/elections.

"It is important that the county committee reflects the demographics and agricultural interests of the community these individuals represent," Garcia said. "I strongly encourage all producers, including women, minority and beginning farmers and ranchers to participate in the nomination and election process," he said.

County committees are comprised of three to five members elected by local producers. All newly elected county committee members and alternates will take office January 2, 2012.

Nomination forms must be postmarked or received in the local USDA Service Center by close of business on August 1, 2011.
